Promoting a low-carbon, inclusive green economy and mitigating climate change through amending law on waste
MIRIM Consultant LLC is providing consulting services on the “Development of draft legislation to improve the legal framework of waste management,” commissioned by Caritas Czech Republic INGO, from May 21 to August 15, 2024. The goal of this consulting service is to identify challenges and impacts on society and explore the need for legislative changes based on the current assessment on ‘Law on Waste’. The objective is to develop effective waste management policies that align with Mongolia’s long-term development strategy policies.
The consulting services follow the Methodology for Drafting Legislation, as per Annex 2 of Resolution No. 59 of 2016, “Approving Methodology” of the Government of Mongolia, in line with the “Law of Mongolia on Legislation.” Our focus during the legal formulation was on the principles of “polluter pays” and recycling waste into the economy. Within the framework of this consulting service, the following activities are planned and performed. It includes:
As part of the consulting service, the research team has reviewed the evaluation of the consequences of the implementation of the Law on Waste, which is conducted in 2023, analyzed other available materials related to waste regulation, and conducted research and analysis from the government agencies responsible for organizing the implementation of the law and the subjects affected by it.
Moreover, the team has conducted comparative studies on waste management practices in countries with similar economic, social, ecological, and geographical contexts to Mongolia. Focused on strategies for reducing pollution, promoting waste-free consumption, enforcing the “polluter pays” principle, and integrating waste recycling into the economy. Based on the results of the research, created draft laws and regulations, including concepts and detailed legislative proposals. And, developed presentations, effectiveness evaluations, and cost estimates for the draft law.
In addition, prepared a catalogue of the draft proposals for amendments to the law and draft regulations for the public and interest groups, drafts of proposals to be discussed. In connection with the amendment of the law, list of proposals for amendments to other laws and necessary administrative normative acts to support Waste law amendments have been drafted as well.
The proposed amendments to the Waste Law are expected to significantly reduce environmental pollution and waste production. They will have a positive impact on manufacturers, importers, and service organizations by promoting sustainable practices. Additionally, these amendments will create new business opportunities for small and medium-sized enterprises (SMEs) that offer waste management services, fostering a greener and more inclusive economy.
